Abstract

Law serves as the protection of human interests. In order for human interests to be protected, the law must be implemented. The implementation of the law can take place normally, peacefully, but it can also occur due to legal violations. This study aims to explain the mechanism of law enforcement against traffic violations by minors which resulted in other people dying. To describe criminal sanctions received for violations of underage traffic that result in other people dying. To explain the enforcement of the law in relation to a sense of justice for the parties concerned. This study uses a normative juridical approach. This type of research is case / field research. Case / field research is a study that aims to study intensively the background of the current state and the interaction of the environment of an object. So that it can be obtained carefully, thoroughly, and clearly analysis and facts about the process of resolving cases of underage child traffic violations that cause other people to die (case study in Surakarta City Police). The results showed that law enforcement against traffic violations by minors which resulted in other people dying through diversion, namely at the level of investigation, prosecution, and examination of cases in a district court must be sought for diversification, provided that the crime is committed; threatened with imprisonment for a maximum of 7 (seven) years and not a repetition of a crime. Criminal sanctions that are applied in violations of underage traffic that result in other people dying, namely the verdict of judges based on Law No. 3 of 1997 in the Draft Child Criminal Justice System Bill in the form of criminal or action. perpetrators are still subject to punishment for the incident through the procedures that apply according to the Child Criminal Justice Act as appropriate.
