Abstract
In medical science a labor process could be done normally or cesarean section. In carrying out a labor, especially cesarean section suegery, of course there is a relasionship beetween the doctor and the patien. The doctor must make every effort so that the action taken in the ceasarean section were successful, while the patient must obey all doctor’s order related to the cesarean section, so that that cesarean section could work well. The relation beetween the doctor and the patient occured because of agreement beetween the two to produce a concurrence as stated in aricle 1320 paragraph 1 of KUHPerdata ti carry out cesarean section. The purpose of this study was to investigate to process of implementation the agreement between doctor and patient in a cesarean section, the right and obligation of each party in a cesarean section, and the legal responsibility og the parties if there was an errorin a cesarean section. Approach method used basedon legal research was a normatif approach that examined the prisiples of legal law and legal regulation in the implementation of cesarean surgery. The research was descriptive which provides a systematic and comprehensive description of the legal responsibility of doctors and patient in the implementation of cesarean section. The result of the research state that in the process and implementation of the agreement cesarean surgery must meet the regulation that govern it, the term of administrative requirement, legal requirement, informed counsent and helth requirement. Then an agreement occured with the signing of the approval letter that held been provided by RSUD dr. Soedono Madiun. So that with the agreement of the doctors and patient the cesarean section could be performed. And the existence of an agreement gave rise to legal relations and gave rise to the right and obligations of doctor and patiens cesarean section in RSUD dr. Soedono Madiun. The right of a cesarean patient in RSUD dr. Soedono Madiun is the obligation of a cesarean surgeon in RSUD dr. Soedono Madiun and vice versa, the right of the doctor is the responsibility of the patient. If there was an error from one of the parties in the cesarean section, then they must be able to be responsibility on the basis of default and unlawful conduct if there is no good faith in conducting a cesarean section surgery agreement.
