Abstract

This research is entitled “Analysis of Islamic Law on the Practice of Istiṣna’ Contract”. It studies the practice of Istiṣna. Istiṣna is a transaction where sale and purchase occur through orders and it is one of the types of trading that is mostly employed by society. In general, the buyer comes to the seller in order to ask that something should be made while its physical conditions do not yet exist. The problem found in this research is the practice of sale and purchase which occurs through orders at Hawe Mebel and whether this kind of practice is in accordance with the current Islamic law. The objective of this research is to figure out the concept of Islamic regulation towards the sale and purchase through orders and to find out the practice of trading discovered at Hawe Mebel. This research is categorically a qualitative research with data analysing inductively. The result of this research demonstrates that the process of trading through orders found at Hawe Mebel is in accordance within the legal Islamic regulation where the transaction that occurs between the buyer and the seller is an agreement met for the cost and the payment system. The seller then takes a note to list the name of his customers with their orders, the money that has been paid, and the shipping adjusted based on the agreement of both parties, the buyer and the seller.
