Abstract

In the execution of auctions there are several procedures that must be fulfilled in order to have legal force. Many people do not understand what the purpose of the auction itself is and how it is implemented even though there are laws governing it. In the Minister of Finance Regulation Number 93/PMK.06/2010 as amended by the Minister of Finance Regulation Number 106/PMK.06/2013 if want to conduct an auction, there must fulfill the required documents both subject and object. Auctions occur when in making an agreement between a creditor and a debtor within a certain period of time with collateral in the form of moveable or immovable property and the debtor does not fulfill a predetemined agreement on the basis of repayment of goods that have been pledged, the creditor has the right to pay off his own power by selling goods belonging to the debtor that have been pledged as collateral in the agreement. Auctions conducted on the basis of the object of underwriting rights must fulfill document such as APHT, SKMHT, SKT, etc. The results of the research that can be concluded by the author are that basically every KPKNL always examines the procedure to carry out the auction. The document is very important in carrying out this auction execution process. If one of these documents is not fulfilleed, the auction can be cancelled or null and void according to certain circumstances.
