Abstract

ABSTRACT Guarantee objects to others, an agreement must be made. One material guarantee is a guarantee of mortgage. Pawn that is in great demand by the community, namely pawning with the sharia system. To find out how the procedure for implementing a sharia pawn agreement, the author conducted a study at the Surakarta Islamic Pawnshop with a gold guarantee. This study aims to determine the contents of the gold pawning agreement, procedures for conducting a gold pawn agreement and knowing the possible risks that occur in gold pawning products at the Surakarta Islamic Pawnshop. The method used in this study is normative juridical. This study the author uses primary, secondary and tertiary data. Methods of data collection using library research collection techniques, field studies consisting of observation and interviews. The method of data analysis uses qualitative descriptive techniques. The implementation of the sharia gold pawning agreement has been carried out in accordance with the provisions of the Regulations concerning the pawn agreement and the order for the implementation of the stipulated pawn agreement.
