Abstract

This study has the objectives: a) To find out the Terms of Fair Use / Fair Dealing Based on Law No. 28 of 2014 concerning Copyright. b) To know the law enforcement by the police on the copyright of books. The approach method used is juridical, namely the approach to law as a norm, namely Law No. 28 of 2014 concerning Copyright with an approach to the existing reality regarding fair use / fair dealing rights to Sriwedari Book Seller books, Surakarta. The type of research used in this study is descriptive, namely the type of research that gives a real picture.The first step in the process of doubling the book is in the form of copy. In Law No. 28 of 2014 concerning Copyright is regulated in Article 44 Paragraph (1) Use, retrieval, duplication and / or alteration of a work and / or product of Related Rights in whole or in part substantially is not considered a Copyright violation if the source is stated or stated complete.Based on the results of research on the copying of books carried out by book merchants in Sriwedari Surakarta, either through copy or computer scan, it is not included in the category of FairUse / Fair Dealing because Sriwedari book traders in Surakarta violate the provisions of the use of Article 44 and Article 46.Sriwedari Book Traders in Surakarta take advantage outside of the 2 Articles, while FairUse / Fair Dealing is permitted from origin in accordance with Article 44 and Article 46. Legal remedies help the holder of the copyright work to obtain protection against the copyrighted work owned. The view of Islamic Law concerning copyright over the multiplication of books is an act that is violated, this is because it is an act of forgery, lying, wrongdoing to the creator for taking advantage of his work in an improper way, and consuming property from the creator because doubling gets economic benefits.
