Abstract
In a pawn agreement that has been agreed to be carried out by the parties, where the agreement raises the rights and obligations that must be fulfilled by the parties. If an achievement is not fulfilled it will cause consequences that must be held accountable for the action and require the parties to compensate. This aims to find out about the implementation of the mortgage agreement between PT. Pegadaian (Persero) and customers in relation to the principle of freedom of contract, know the rights and obligations of PT. Pegadaian (Persero) and customers in a mortgage agreement and know the legal consequences if one of the parties made a mistake in the mortgage agreement. The approach method used in this study is a normative method in which the method that examines law is based on rules and principles in law. This writing uses a type of descriptive research, which is a study that describes and describes data regarding mortgage agreements in the relationship of the principle of freedom of contact. The results of this study indicate that the mortgage agreement with the principle of freedom of contract applies to PT. Pegadaian (Persero) is PT. Pegadaian (Persero) is free to make a pawn agreement. The pawn agreement is made by default by PT. Pegadaian (Persero) and customers are free to choose to carry out a mortgage agreement or not to implement it. The rights and obligations of the parties are carried out if PT. Pegadaian (Persero) and customers have agreed to an agreement and require parties to implement it. As a result, if one of the parties makes a mistake in the agreement, if the debtor does not fulfill the obligation to repay and redeem the mortgage according to Article 1243 of the Civil Code, the auction will consequently be auctioned. PT. Pegadaian (Persero) has the obligation to maintain and maintain customer liens. If the pledge is damaged or lost then the deed is considered an act against the law pursuant to article 1365 of the Civil Code because of errors and negligence resulting in customers experiencing losses and requiring PT. Pegadaian (Persero) to compensate for these losses.
