Abstract
The matter of adultery or in the Indonesian criminal code called ‘gendak’ (overspel), essentially still a lot going on in Indonesia. The handling of the case against adultery committed by men as well as women who are married are categorized as hard enough revealed the existence of a need to because the capture process hands are committing adultery. On one side of the role of the police force of the Republic of Indonesia is very important so that the perpetrators of adultery can be set to be a suspect. As for the laws governing adultery, currently only provided for in the Indonesia Criminal Code of a colonial nature is still at odds with the culture of the community in Indonesia. On the Indonesian criminal code is need for an absolutly requirement against adultery, which is done by people who are already married. So for male or female who has not yet been tied to marital status, can not easily on claims by doing the crime of adultery. Thus need a legal system that can uphold the dignity and the dignity of marriage, in order to reduce the number of adultery in Indonesia.
