Abstract

A contract is a written agreement that contains a permit (bid) and qabul (acceptance) between one party and another party which contains the rights and obligations of each session with the sharia principle. One of the contracts used by BMT in buying and selling based transactions is murabahah. Murabahah is a buying and selling contract where the bank acts as a seller while the customer is a buyer. In the murabahah agreement on the settlement of disputes at KSU BMT the legal Arafah used to settle sharia banking disputes carried out legal domicile at the District Court office with the costs of litigation and court fees borne by the parties this matter is not in accordance with the MUI National Sharia Council Decree No. 04/DSN/-MUI/IV/2000 concerning Murabahah which regulates the settlement of disputes on the fifth provision number 2 dispute resolution can be through the Sharia Arbitration Board after an agreement is not reached through deliberation.
