Abstract

BUMDes become a useful business enterprise community needs, specially, empowering village resources as a driver of the economy of rural communities, arranged in Act No. 6 of 2014 about the Village. Legal basis BUMDes, using are 1) Act No. 6 of 2014 about the Village, 2) Act No. 32 of 2004 about Local government, 3) Government Regulation Number 72 Year 2005 Concerning Villages, 4) Regulation of the Minister of Home Affairs Number 39 of 2010 on Village Owned Enterprises, and 5) Government Regulation Number 38 Year 2007. Business units within BUMDes that can be developed include: village drinking water, village electricity business, food barns, and local resources and other appropriate technologies. This study aims to explain the Statutes / Bylaws and organizational structure of the Tirta Mandiri Village Owned Enterprise by the Village Government of Ponggok and describes the management of business units in the Tirta Mandiri Village Owned Enterprise based on BUMDes Village Rules and Village Law. This research is a literature legal research. Methods of data collection through literature study. Technical analysis of data using deductive logic. The results showed that 1) Establishment of BUMDes and management of business units in BUMDes is difficult in accordance with laws and regulations Village Rule Number 6 of 2009. In addition, the management of business units in Tirta Mandiri BUMDES Klaten also in accordance with Statutes / Bylaws of BUMDes Tirta Mandiri and Village Law no. 6 years 2014. The management of business units is also in accordance with Article 8 of the Articles of Association of Tirta Mandiri BUMDes that type of business unit of BUMDes includes among others business unit: clean water management, fishery, tourism ponggok, credit, culinary kiosk and shops. 2) The responsibility of the management of BUMDES Tirta Mandiri and Ponggok Village Chief to the welfare of the people of Ponggok Village is in the form of profit sharing resulted that is 30% of net profit is handed over to the Ponggok Village as the Original Income. The responsibility of the management of BUMDES Tirta Mandiri in accordance with Article 14 of the Articles of Association of Tirta Mandiri BUMDes is to provide Accountability Report (LPJ) to the Commissioner held at the end of January next year.
