Abstract

Narcotics are substances or drugs referred medically to any psychoactive compound with sleep inducing properties. They are dangerous to be used without prescription and/or supervision from the medical party. Illegal use of these can lead to addiction, seizures, stupor, and even death. Besides, narcotics trafficking is also illegal as regulated in Act No. 35 of 2009 on Narcotic. It could result in jail time and rehabilitation for illegal drugs use. There are numerous drugs crime under the jurisdiction of Karanganyar District Court. Hence, fierce law enforcement is needed to decrease and prevent it happen again. Collaboration between law enforcer such as Police, Prosecutor, District Court, and Advocate are essential according to their own obligation. Law enforcer are hopefully able to comprehend the legal facts of suspect or defendant which is caught as drugs dealer, illegal user, even drugs addicts. Hopefully, their acts are not only based on the legislation but also legal breakthrough with progressive legal approach to categorize the status of suspect or defendant as drugs dealer or illegal user. The nature of progressive law is that law are meant for human, not the opposite, so that the central character is human. Hence, in implementing the law, law enforcer are not only reading the legislation plainly, but also finding the value and the meaning of it. Only then substantive justice can be created. The suspect or defendant can receive their penalty based on the category of drug dealer or drug addicts.
