Abstract

Crime against infanticide is a crime that damages the values of humanity and also lower the degree of humans, especially the perpetrators of infant disposal is a child, then this becomes a problem that needs to get more attention. The problem under investigation is whether the reasons underlying the perpetrator to perform the act of disposal of baby, how the rules of criminal law related to children as perpetrators of the act of disposal of babies, how the protection of the rights of children as perpetrators of infant disposal in the criminal justice process. The method used by the author in this research is empirical juridical method. The results of the author's research are the reasons underlying the child to throw away the baby due to extrinsic factors and also the lack of knowledge about the law and religion rules about the disposal of infants, the rules of criminal law related to the disposal of infants regulated in the Criminal Code and also outside the Criminal Code namely the law, - the child as the perpetrator pembuangn baby done through the process of diversion and also the general court.
