Abstract
This research aims to know the process Delays Debt Payment Obligations and to know the judge's consideration in deciding the decision Delays Debt Payment Obligations on a Cooperative Loan Mitradana Semarang. This research uses the Juridical-Normative methods are purely descriptive. The data source consists of the secondary data that includes source of a primary law, secondary and tertiary, whereas the primary data is direct interview which related to the issues examined in the Office of the Law Court of Commerce in Semarang District Court and Advocate Eka Windhiarto, S.H., Sp. N., M.H., CLA. Method of the data collection by the study of librarianship and field study i.e. interview, then analyzed by a qualitative analysis. The findings showed that the process of Delays Debt Payment Obligations (PKPU) on Cooperative Loan Mitradana has been appropriate as provided for in Law Number 37 Year 2004 about bankruptcy and Delays Debt Payment Obligations, whereas the judge’s consideration in determine of decision is by looking at how the process of proof in conference conducted by the parties and the evidence based on the facts and the reasons of the parties.
