Abstract

In Law Number 1 Year 1974 regarding Marriage. Marriage is the inner bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on the One Godhead. However,marriage is not always able to walk smoothly because there are times where the differences arise between husband and wife so that result in divorce. One of them if the marriage that has been diterbina long then known one of the parties both husband and wife convert from Islam to non-Islam or apostate, so that the husband and wife can apply for divorce to the Religious Court of the authorized. The Religious Courts in deciding the divorce due to conversion or apostasy by the decision of fasakh is absolutely proven legitimately and convincing the Petitioner to quit the religion of Islam or apostate (returning to the original religion of Christianity). The formulation of the problem in this study discusses the consideration of the Panel of Judges in deciding the divorce because one of the parties of apostasy and the resulting legal consequences that occurred in the Religious Court of Sragen on the Decision of the case Number 1120 / Pdt.G / 2013 / PA.Sr. This research uses normative juridical research type is qualitative.
