Abstract

This study aims to determine the criminal law policy towards justice collaborator and the implementation of the right of justice collaborator in the High Court of Central Java. The research method using empirical juridical approach is descriptive. Sources of data consists of primary data ie interviews and secondary data namely primary, secondary and tertiary source data law. Methods of data collection through literature study and field study (interview), then the data were analyzed qualitatively. The results show that the criminal justice collaboration policy is regulated through Law No.13 of 2006 on Protection of Witnesses and Victims, then the issuance of Law No. 31 of 2014 on Amendment to Law No.13 of 2006 on Protection of Witnesses and Victims, Law No. 31 of 2014 has changed the provisions of Article 10 and added Article 10 A in the form of special handling that can be obtained by justice collaborator which aims to provide better legal guarantees to justice collaborator. Implementation of the rights of justice collaborator can be given from the beginning, namely the provision of protection in the form of identity hiding, and if the justice collaborator feels that his or her family's safety is threatened, the investigator can apply for protection to LPSK. While undergoing the process of execution of the verdict, the justice collaborator still obtains protection in the form of placement in a special block as well as special supervision in the fulfillment of his rights as well as awarded in the form of criminal relief, additional remissions and parole.
