Abstract

Murābaḥah contract is to sell an item by confirming its purchase price to the buyer and the buyer pays it at a more price as profit. Murābaḥah agreement is one of financing the sale and purchase that can help the surrounding community in meeting their needs. Murābaḥah scheme is done between seller and buyer through Baitul Māl Wa Tamwil (BMT) intermediary. BMT is entitled to receive profit from the contract result. A person must pay to the BMT based on the agreement that has been done. This can be seen in the provisions set forth by the Fatwa DSN MUI Number 04 / DSN-MUI / IV / 2000. Such provisions shall be made by any financial institution or legal entity, because if it is inconsistent with the DSN Fatwa then the financial institution has deviated from the Fatwa DSN. This is what prompted the author to conduct an in-depth study of " Fatwa National Sharia Council of Indonesian Council of Ulama of the analysis on the concept of murabaha contract in Baitul Māl Wa Tamwil beeMASS Ngawi". This study aims to get an understanding of the conformity of the concept of murābaḥah in BMT beeMASS Ngawi concerning to the instructions of DSNMUI. The type of this research is used field research with qualitative descriptive approach. The method used in data collection is interview and documentation. The analysis used is deductive method. The results of this study can be concluded that BMT beeMASS Ngawi has implemented the above provisions in accordance with the fatwa of the National Sharia Council of Indonesian Council of Ulama No. 04 / DSN-MUI / IV / 2000 which explains about murābaḥah scheme.
