Abstract

This study aims to determine the judge's judgment in determining the acceptability of permission application to establish a marriage of different religions and to know the legal consequences caused after the establishment of judges on the marriage of different religions. The approach method used by the writer is normative because the studied is the rule of law and the legal principle contained in the society so that it can be known the position of law and legality. This research is descriptive because it describes systematically and thoroughly on permission application to hold marriage of different religion. The result of the research shows that the judge of the court gives the wisdom in the form of the consideration of the granting of a marriage of different religions in which the applicant submits to follow the belief of the applicant's partner and the judge based on the jurisprudence of the Supreme Court dated January 20, 1989 Register Number 1400 / K / Pdt / 1986 whose contents are parents allowing the applicant to marry even with different religions. As a result of the law after the establishment of a judge, the marriage can take place after obtaining the court and the formal and material requirements have been fulfilled and the legal consequences of the child born of this religious marriage are legitimate children.
