Abstract

Marriage is a bond that gives birth to a family as one element in the life of society and also state. Presence of children in the family will cause the obligation for both parents to educate, protect and maintain so that the welfare of the child is awake. This welfare must be a fundamental right for the child. In addition the child is also entitled as a successor and be the heir of the inheritance of his parents. To uphold the value of justice, the Constitutional Court in its Decision Number 46 / PUU-VIII / 2010 stipulates the status of the child outside the marriage of a judge. The Constitutional Court stipulates that an outsider has a civil relationship with his biological father, so that justice and legal certainty can be realized in the inheritance position.
