Abstract

Purpose of the research was to know profile of legal rules and legal application of them on a fatal violent crime disguised as dukun santet (sorcerers) eradication and to know considerations of judges in determining decisions with permanent legal forces in the fatal violent crime disguised as dukun santet eradication. The research used normative-juridical approach. The research was a descriptive research. Location of the research was District Court of Wonosobo and District Court of Brebes. Data of the research was secondary data collected by using literature study and interview. Based on results and discussion of the research, it can be concluded that application of law on defendants of the fatal violent crime used Article 170 (2) 3rd of Criminal Code because the Article considered to be suitable for crime committed by the defendants, namely collective violence that were conducted in open public spaces at the same time and mutual agreement and understanding to commit the violence toward victims had been set previously.
