Abstract

This study aims to determine the judge in determining the verification and determining the decision of the divorce case because of the affair in the marriage of different religions and the legal consequences in the Surakarta District Court. The research method used a descriptive normative juridical approach. Data source consists of primary data that is result from interview and secondary data that is primary and secondary law data. Methods of data collection by literature study and field study (interview) then the data were analyzed qualitatively. The results of the research indicate that the judge in determining the evidence based on the lawsuit and acknowledgment that has been connected with the evidence in the trial. The judge considered the proof that the Defendant had proved an affair in a religious marriage so that a divorce took place, then the judge decided to be won by the plaintiff because based on the verification examination in the hearing. The legal consequences after the divorce because of an affair in a religious marriage that is about a minor, is taken care of by the mother until the child is an adult and can decide on his own, but the father takes responsibility for all child care and education costs, besides the former husband - the wife should not be related like a husband and wife. Furthermore, the property of a married couple in his marriage which concerns his inheritance property can be done according to Islamic law, customary law, and civil law of BW.
