Abstract

This study aims to determine the process of settling cases and judges' judgment in determining the verification and decision on the case of home renovation between the contractor and the owner of the house in the Surakarta District Court. This research uses normative juridical method which is descriptive. Source of data consist of primary data that is result of interview, while secondary data consist of primary, secondary and tertiary law data source. Methods of data collection by literature study and field study (interview). After the data collected and then analyzed qualitatively. The results show that the process of settling the case through the examination, where the judge decided in this case to grant the Plaintiff's claim for part and refuse / not accept the rest. The consideration in determining the proof is proved to have occurred wanprestasi as in Article 1243 Civil Code conducted by the Defendant, while the judge's judgment in determining the decision because the Plaintiff is able to prove the arguments of the lawsuit, the Judge gives legal considerations which will be used as guidance in deciding the decision, Where the judge to grant the Plaintiff's claim is only granted partially and refuses to be in addition to and beyond.
