Abstract

This study aims to analyze the judges' consideration of the Religious Court of Salatiga in providing marriage dispensation; To know the causal factor so that there are many application of dispensation of marriage in Religious Court of Salatiga; As well as to know and analyze the impact of the provision of marriage dispensation to the Religious Courts of Salatiga, the applicant for married dispensation and the regulation of Islamic law according to the clergy in the community. This research is descriptive and employs normative-empirical approach, and analyzed using qualitative analysis. The results of the research indicate that the judge in considering the establishment of marriage dispensation see in terms of maslahahnya and whether or not the application is proven in the trial. The cause of the number of submissions dispensation in the Religious Court of Salatiga because of the interests of the applicant and the public pressure, which is because the bride has been pregnant first. The impact of this dispensation that the appellant deemed positive would be positive, the dispensation given according to one of the scholars in Salatiga if the judge had considered the reasons and evidence during the trial that the bridegroom was the man who impregnated the bride and groom then the marriage could be done.
