Abstract

Warranty is from the debtor happens by the operation of law and is a mandatory rule: any chattels or movable property of the debtor be dependents debts to creditors. Treaty of debts there must be a Guarantee, the guarantee should be able to cover all debts agreement so that in the future no one suffered losses due to guarantee debts does not correspond to a loan big enough but the price of the collateral is insufficient to pay off his debts if the debtor do tort such as Sragen District Court Ruling Case number: 45/Pdt.2016/PN. Sgn warranties given by the defendants cannot cover the whole of the debts which totaled is large enough. The plaintiff felt aggrieved because it guarantees a plot of land with a certificate of property rights: SHM number 4277, area: 535m2 on behalf of the holder of the Rights iwinarsih in villages Masaran, Masaran, Sragen district Sub District, Central Java province does not or has not been sufficient to pay the obligations of the Defendant Keywords: guarantee, agreement, debts
