Abstract

The purpose of study aims to determine how the procedures and process of law enforcement officers in performing a determination of diversion for children as perpetrators of criminal acts of sexual abuse and any obstacles that arise. This study includes a normative juridical research. Data collection techniques to the study of literature and interviews. The data source consists of the primary data and secondary data in the form of interview materials both primary and secondary law. Descriptive data analysis technique that is deductive. The results showed that the procedure used or applied that Act No. 12 of 2012 on the Criminal Justice System Child and PERMA No. 4 Year 2014 on Guidelines for Diversion in the Criminal Justice System Child is an attempt of diversion is done at every level of scrutiny, both at the level of investigation, the prosecutor or the court level. While the process of applying the diversion conducted by investigators with the consultation or mediation to the parties to the formation of an agreement diversion agreed by the parties, at the district court level, the result of the agreement submitted to the Chairman of the District Court to obtain a determination, then the result of the determination was delivered to the parties to be implemented , As for the obstacles that arise in conducting the case study can be divided into five factors: factor of legislation, law enforcement apparatus, means or facility of factors, community factors, and cultural factors.
