Abstract
This research aims to analyze the urgency of strengthening criminal law in Indonesia in tackling deviant LGBT behavior which is increasingly widespread in society. This phenomenon creates significant legal debate due to the conflict between principles of individual freedom and religious norms, morality, and Pancasila values. The research method used is normative legal research with a statutory approach and a conceptual approach. The research results show that Indonesian positive law at present, both in the old Criminal Code and Law No. 1 of 2023, has not fully accommodated criminal prosecution against adult LGBT behavior in the private sphere. There is a legal vacuum that makes it difficult to take maximum preventive and repressive actions. Based on Article 28J of Law No. 39 of 1999, human rights in Indonesia are constitutionally limited by moral and religious norms. The conclusion of this research emphasizes the need for the formation of special regulations (lex specialis) or the strengthening of moral offenses in national criminal policy to protect public order and the nation's religious identity
