Abstract

The rapid development of information technology has driven a shift in the workforce recruitment process from conventional systems to digital systems utilizing various online platforms. While digital recruitment provides efficiency in the selection process, it also increases the risk of misuse and leakage of prospective workers' personal data. This study aims to analyze legal regulations regarding personal data protection in the recruitment process in the digital era and to formulate an ideal form of legal protection for prospective workers. This study is a normative legal study with a statutory approach and a conceptual approach. The results show that the policy for protecting prospective workers' personal data in Indonesia has an adequate legal basis, but its implementation is still suboptimal due to weak supervision, low compliance of data controllers, the absence of comprehensive technical regulations, and the absence of an independent personal data protection agency. Ideal legal protection needs to be realized through the implementation of preventive legal protection in the form of compliance with data processing principles, transparency, and strengthening information security systems, as well as repressive legal protection through the application of administrative sanctions, civil liability, and criminal sanctions for violations of personal data protection, thereby providing legal certainty and guaranteeing the protection of prospective workers' privacy rights in the digital recruitment process. Regulations as guidelines for the recruitment process have a legal basis, but they cannot be considered ideal or optimal due to the gaps between legal provisions and technical implementation in the field. Protection mechanisms also provide a basis for protecting prospective workers, but they have weaknesses in their prevention aspects.
