Abstract
The circulation and abuse of psychotropic substances constitute a crime with serious impacts on society, particularly the younger generation. This study aims to analyze the regulation of the criminal act of criminal conspiracy to possess psychotropic substances without rights in Indonesia and to analyze the judge's legal considerations in Decision Number 13/Pid.Sus/2025/PN Byl. The method used is normative legal research with a legislative and conceptual approach, using secondary data analyzed qualitatively. The results show that the regulation of criminal conspiracy to possess psychotropic substances without rights is regulated in Article 62 juncto Article 71 paragraphs (1) and (2) of Law Number 5 of 1997 concerning Psychotropics. The Panel of Judges of the Boyolali District Court has applied these norms by declaring both defendants proven guilty and imposing a prison sentence of 9 months and a fine of IDR 2,000,000.00 for each defendant. However, from the perspective of legal purpose (rechtdoel) according to Gustav Radbruch, this decision does not fully reflect proportional justice because there is no sentencing disparity between the principal perpetrator (dader en pleger) and the accomplice (medeplichtige), even though the trial facts show a significant difference in roles. Therefore, the application of a restorative sentencing paradigm that considers the degree of criminal responsibility of each perpetrator is needed
