Abstract
Marriage is a physical and spiritual bond between a man and a woman aimed at forming a happy and enduring family based on the belief in the One and Only God. However, contemporary social developments have seen the emergence of the "lavender marriage" phenomenon—a marriage entered into to conceal an individual's sexual orientation. This phenomenon can give rise to legal issues if one party conceals material facts about themselves, thereby causing the other party to grant consent to the marriage under a misconception. This study aims to analyze the legal reasoning employed by the judge in granting the annulment of a marriage due to same-sex sexual orientation in Ngawi Religious Court Decision Number 900/Pdt.G/2025/PA.Ngw, as well as to analyze solutions for addressing and preventing similar issues. A normative-juridical research method was employed, utilizing data from statutory regulations, the Compilation of Islamic Law, legal literature, and the aforementioned court decision. The findings indicate that the judge's decision to grant the annulment was based on the presence of a misconception and fraud regarding the Respondent's personal circumstances, as stipulated in Article 27 paragraph (2) of Law Number 1 of 1974 concerning Marriage in conjunction with Article 72 paragraph (2) of the Compilation of Islamic Law. The concealment of same-sex sexual orientation and specific health conditions was deemed a material fact that vitiated the intent required for the marriage contract. Preventive measures can be implemented through pre-marital counseling by the Office of Religious Affairs (KUA), comprehensive pre-marital health screenings, and raising public legal awareness. Meanwhile, remedial measures include marriage annulment, claims for damages based on Article 1365 of the Indonesian Civil Code, and criminal liability if the elements of fraud are met.
