Abstract

In legal practice, copyright and trademark rights are two forms of Intellectual Property Rights (IPR) regimes that most frequently intersect. Copyright provides legal protection for various artistic, scientific, and literary works that have been tangibly expressed, whereas trademark rights serve to secure identifying signs or symbols used to distinguish products or services in commercial activities. This research aims to provide a juridical analysis of copyright registration for a work that has already been utilized as a registered trademark and to examine the legal protection afforded to registered trademark holders. The study employs statutory, conceptual, and case-based approaches. Data sources comprise primary legal materials (Supreme Court Decision No. 121 K/Pdt.Sus-HKI/2025, the Copyright Law, and the Trademark Law), as well as secondary and tertiary materials, all collected through literature review and qualitative analysis. The findings indicate that the copyright registration obtained by Suharman Salim for the painting "SECANGKIR TEH" (A Cup of Tea) was declared invalid and null and void by operation of law for violating Article 1 point 1 and Article 65 of the Copyright Law; this was because the work had already been used and registered as the "LUKISAN" (Painting) trademark by Lie Tjie Kiat since 1998. The Supreme Court granted the trademark holder's appeal for cassation, citing bad faith and a violation of the "first-to-file" principle. While legal protection for trademark holders is substantively established, the procedural aspect lacks efficiency, as it necessitates a separate, time-consuming, and costly process to invalidate the copyright. The study recommends strengthening the substantive examination system at the Directorate General of Intellectual Property (DJKI) and enhancing the integrity of trademark and copyright databases to prevent similar disputes in the future.
