Abstract
Premeditated murder is a serious crime against life in Indonesia's criminal law because it involves planning and intention before the act is committed. This study looks into the legal reasons behind Ferdy Sambo's conviction in Decision Number 813 K/Pid/2023 and explores how this decision is relevant when viewed through a progressive legal lens. The method of research used is called normative legal research, which includes looking at laws, concepts, and specific cases. Information was gathered by reviewing various types of legal documents, including primary, secondary, and tertiary sources. This information was then examined qualitatively using deductive reasoning. The study's results show that the reasons for Ferdy Sambo's conviction follow the rules set by Indonesian criminal law. This is shown by meeting all the requirements for the crime of premeditated murder as described in Article 340 of the Criminal Code. This is backed by solid evidence, facts from the trial, and legal reasoning based on the rules of criminal procedure and accountability. From a forward-thinking legal point of view, the decision not only shows how the law is applied in a formal way but also highlights a focus on real justice, safeguarding human values, considering what is best for society, and rebuilding public confidence in law enforcement agencies. This decision confirms that the law should be applied equally to everyone, regardless of the person's status or position. This upholds the idea of equality under the law and supports the credibility of the criminal justice system in Indonesia.
