Abstract
Indonesia is a country that has abundant natural resources, especially in the fields of oil, gas, and minerals. This research examines two main issues is (1) the legal regulation of petroleum mining business licensing under the risk-based licensing system; and (2) the legal regulation prohibiting petroleum mining in small islands and its relation to the principles of sustainable development. The background of this research stems from the finding that 266 Mining Business Licenses (IUP) operate across 477 small islands in Indonesia, despite Law Number 27 of 2007 in conjunction with Law Number 1 of 2014 on the Management of Coastal Areas and Small Islands (UU PWP3K) explicitly prohibiting mining activities in such areas. This research employs normative legal research methods with a statutory approach, conceptual approach, and case approach through the analysis of Constitutional Court Decision Number 35/PUU-XXI/2023. The data used consists of secondary data comprising primary, secondary, and tertiary legal materials, analyzed qualitatively. The results of this research indicate that: First, petroleum mining business licensing (KBLI 06100) is classified as high-risk under Government Regulation Number 28 of 2025, requiring strict compliance including environmental permits (AMDAL), Approval of Spatial Utilization Activity Conformity for Sea Areas (PKKPRL), and upstream oil and gas technical licensing. Second, petroleum mining activities located on small islands contain substantive legal defects as they contradict the prohibition in Article 35 of UU PWP3K, which has a higher hierarchical position than government regulations, rendering such permits null and void by law. This condition also contradicts the principles of sustainable development, particularly the precautionary principle, the polluter pays principle, and the principle of intergenerational equity
