Abstract
The development of digital technology has driven a transformation in buying and selling practices, including the emergence of virtual gold transactions, which raise issues regarding their legal validity from the perspective of civil law and Islamic economic law. This study aims to analyze the concept of implementation and validity of virtual gold buying and selling based on positive law provisions and Islamic principles. The theoretical framework used includes the theory of agreement (the principle of consensualism) in the Civil Code and the theory of contracts in Islamic jurisprudence, with reference to the valid conditions of an agreement in Article 1320 of the Civil Code and the pillars and conditions of sale and purchase in the Compilation of Islamic Economic Law. The methodology used is normative legal research based on a regulatory approach, with a literature review of primary and secondary legal materials. The results of the study indicate that from a civil law perspective, virtual gold buying and selling can be considered valid as long as it meets the elements of agreement, capacity, a specific object, and a lawful cause, although there are potential problems with the intangible object aspect. Meanwhile, from the perspective of Islamic economic law, the validity of the transaction is still debated because it has the potential to contain elements of gharar due to the unclear object and delivery. Thus, it is necessary to strengthen regulations and supervision to create legal certainty and protection for the parties.
