Abstract

Geothermal development in Indonesia has transformed from the mining sector to renewable energy. As a high-risk activity (KBLI 06202), its regulation is crucial to balance green energy investment acceleration with environmental protection. This research employs a normative juridical method with statutory and analytical approaches. Secondary data comprising legal materials are analyzed qualitatively to examine the synchronization between licensing regulations and sustainable development principles. he results show that geothermal licensing now implements a Risk-Based Business Licensing system via the OSS platform under Government Regulation 28/2025. Business actors must fulfill NIB, AMDAL, and KKPR requirements. Regulatory transformation enables the utilization of conservation forests through environmental service permits, while mandating ecological risk mitigation to prevent ecosystem damage. Synchronizing ease of doing business with constitutional rights to a healthy environment is vital. Implementing strict liability and in dubio pro natura ensures the national energy transition remains aligned with sustainable development mandates.
