Abstract
Cases of mistaken arrest (error in persona) in Indonesia reflect the gap between the principle of the rule of law and the reality of law enforcement, as victims often fail to secure adequate redress despite the Criminal Procedure Code (KUHAP) providing for compensation and rehabilitation. This study aims to analyze the legal protection policies for victims of mistaken arrest under Indonesian legislation and to evaluate the provisions for compensation and rehabilitation within the KUHAP. It employs Philipus M. Hadjon’s theory of legal protection, Lawrence M. Friedman’s legal system theory alongside Soerjono Soekanto’s five factors of legal effectiveness, and the victimology theories of Arif Gosita and Bambang Waluyo. This is a normative legal study descriptive-qualitative in nature utilizing both statutory and case-based approaches. Data were gathered through a literature review of primary and secondary legal sources and analyzed using a descriptive-normative qualitative method. The findings indicate that while a multi-layered legal protection policy exists normatively, its implementation is hindered by the short timeframe for pretrial hearings, the lack of independence in the Public Prosecutor's screening function, and insufficient integration of the Witness and Victim Protection Agency (LPSK). Furthermore, the provisions for compensation and rehabilitation in Articles 173–177 of the KUHAP remain limited to material losses and fail to meet the standard of an "enforceable right to compensation" as stipulated in Article 9(5) of the ICCPR. The study concludes that regulatory reform and institutional strengthening are essential to ensure that legal protection for victims of mistaken arrest achieves substantive justice.
