Abstract

The rapid advancement of information technology has accelerated the use of digital identity as a means of authentication and verification in electronic agreements. This study aims to analyze the legal protection afforded to legal subjects in the use of digital identity in electronic agreements under the Law on Electronic Information and Transactions, by first examining the validity of legal subjects as the basis for the analysis. This research employs normative legal research using statutory and conceptual approaches. The findings indicate that digital identity has been legally recognized as a means of authentication in electronic transactions; however, it has not yet been able to fully ensure the validity of legal subjects due to limitations in verifying the identity, intent, and legal capacity of the parties involved. This condition has implications for the legal protection of legal subjects in the use of digital identity. Legal protection is provided through preventive measures, including the implementation of reliable electronic systems and the application of authentication and identity verification mechanisms, as well as through repressive measures in the form of legal sanctions in accordance with the applicable laws and regulations. Therefore, it is necessary to strengthen the legal framework and digital identity verification systems in order to enhance legal certainty and the effectiveness of legal protection in electronic agreements in Indonesia.
