Abstract

This study aims to analyze the implementation of the role of Community Counselors in the diversion process for children in conflict with the law at Boyolali Police Resort, viewed from positive law and Islamic law perspectives. This research applies an empirical juridical method with a qualitative descriptive approach through field research at Boyolali Police Resort and the Surakarta Correctional Center, supported by a literature review of statutory regulations and relevant legal scholarship. The findings show that the involvement of Community Counselors in juvenile cases is a legal obligation mandated by Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. Their role is carried out through the preparation of social inquiry reports, child assistance, facilitation of diversion deliberations, inter-institutional coordination, and supervision of diversion agreements. However, implementation still faces several obstacles, including the limited understanding of investigators regarding the function of Community Counselors, the absence of inter-agency standard operating procedures, workload constraints, and social stigma toward children’s families. From the perspective of Islamic law, diversion is consistent with the principles of maslahah mursalah, dar’u al-mafasid, al-‘afwu, ishlah, and deliberation because it prioritizes recovery, guidance, and the best interests of the child.
