Abstract
The advancement of digital technology has fueled the widespread phenomenon of creating and distributing unauthorized WhatsApp stickers featuring other people's faces; while often dismissed as mere jokes, this practice potentially infringes upon rights to privacy, rights regarding one's own image, and personal data protection. This study is grounded in privacy theory and the concept of the face as legally protected biometric data, referencing provisions within the Criminal Code (KUHP), the Electronic Information and Transactions Law (UU ITE), and the Personal Data Protection Law (UU PDP). The research aims to identify the legal protections available to victims regarding their privacy and image rights following the unauthorized use of their facial photos in WhatsApp stickers, as well as to determine the forms of legal liability applicable to those who create or distribute such stickers under Indonesian law. A normative legal research method with a juridical-normative approach was employed. Data were gathered through a literature review of primary, secondary, and tertiary legal sources and subsequently analyzed using a descriptive-qualitative method to formulate systematic legal arguments. The findings indicate that the unauthorized use of an individual's face in WhatsApp stickers constitutes a violation of privacy and personal data rights, as the face is a form of biometric data intrinsic to an individual's identity and is legally protected. Perpetrators involved in the creation or dissemination of such stickers may face criminal, civil, or administrative liability in accordance with Indonesian regulations, specifically the Criminal Code (Articles 433, 434), the Personal Data Protection Law (Articles 1 points 1 & 4, 65, 67), and the Electronic Information and Transactions Law (Articles 27(1), 27A, 45(1)). The study concludes that stronger law enforcement and increased public awareness regarding the protection of privacy and image rights in the digital space are essential to prevent the broader misuse of visual personal data.
