Abstract
The rapid development of information and communication technology in the digital era has brought various benefits to society, but it has also created new forms of crime, one of which is cyberbullying. This phenomenon has continued to increase alongside the widespread use of social media and has caused serious psychological impacts on victims, particularly children and adolescents. This study aims to analyze the regulation of cyberbullying within the framework of Indonesian positive criminal law and to examine the Islamic law perspective on cyberbullying. The research questions focus on how cyberbullying is regulated under the criminal law currently applicable in Indonesia and how Islamic law views such behavior. This study employs a normative legal research method using statutory and conceptual approaches supported by library research. The findings indicate that cyberbullying is not yet specifically regulated under a single legal provision in Indonesia; however, perpetrators may be prosecuted under various legal instruments, including the Criminal Code, the Electronic Information and Transactions Law, the Child Protection Law, and the Witness and Victim Protection Law. From the perspective of Islamic law, cyberbullying is considered a prohibited act because it involves elements of insult, defamation, backbiting (ghibah), and oppression, all of which contradict the principle of protecting human dignity and honor. In conclusion, existing legal regulations provide a foundation for protecting cyberbullying victims, but stronger regulations, more effective law enforcement, and improved digital literacy and moral awareness are necessary to prevent cyberbullying in the digital era.
