Abstract

Digital transformation in government administration through the Electronic-Based Government System (SPBE) is an effort to accelerate the efficiency of public services and transparent bureaucratic governance. However, this digitalization is not entirely free from legal risks. This study aims to analyze the urgency of implementing SPBE within the framework of State Administrative Law and to identify potential abuses of authority by civil servants that may arise amidst the integration of electronic systems. The research method used is normative legal research with a statute approach and a conceptual approach. Data were obtained through literature studies analyzed qualitatively with deductive logic, based on the principles of the General Principles of Good Governance (AUPB) as stipulated in Law Number 30 of 2014 concerning Government Administration. The results of the study indicate that government digitalization, although theoretically able to minimize direct interactions that have the potential to give rise to corrupt practices, in practice still contains significant legal loopholes. These gaps arise from system vulnerabilities, lack of integration between agencies, and the unpreparedness of comprehensive regulations to anticipate data-based abuses of authority. Rent-seeking behavior can still occur in new forms that utilize digital systems. Therefore, strengthening systemic oversight, improving digital literacy among officials, and synchronizing laws and regulations related to cybersecurity and data protection are necessary to eliminate opportunities for abuse of authority. This research confirms that the success of SPBE is measured not only by technological sophistication, but also by the extent to which the system is able to guarantee government integrity and accountability in accordance with the principles of good governance.
