Abstract
The abuse and illicit trafficking of narcotics in Indonesia continue to rise annually, with narcotic recidivism becoming a serious problem in the national criminal justice system. In 2023, 52.97% of the total prison population consisted of narcotics convicts, a large portion of whom were repeat offenders. This study aims to analyze judges' considerations in rendering verdicts against narcotic recidivists and to examine the application of sentencing for narcotic recidivists under prevailing laws and regulations. The research method employed is normative juridical with a case approach and a doctrinal approach. The research objects comprise three court decisions with permanent legal force: Decision No. 561/Pid.Sus/2022/PN Kis., Decision No. 124/Pid.Sus/2024/PN Pal., and Decision No. 189/Pid.Sus/2022/PN Gst. The results indicate that judicial consideration encompasses two dimensions: juridical (fulfillment of criminal elements, evidence, and statutory provisions) and non-juridical (perpetrator's motive, socio-economic background, age, and social impact). Recidivist status is consistently noted as an aggravating circumstance in all three decisions. However, Article 144 paragraph (1) of Law No. 35 of 2009 on Narcotics, which mandates a one-third sentence aggravation for recidivists, was not explicitly and measurably applied, resulting in sentencing disparities between courts. The absence of standardized sentencing guidelines is identified as the primary cause of such inconsistency.
