Abstract
This study is motivated by the increasing cases of Cyber sexual harassment on social media, which cause physical, psychological, social, and economic harm to women as victims. Although Indonesia has established various regulations governing victim protection, their implementation still faces several challenges. This study aims to analyze the legal protection for women victims of Cyber sexual harassment on social media and to examine such legal arrangements from the perspective of Aristotle’s Theory of Justice. The research method used is normative legal research with a qualitative approach, focusing on library research of laws and regulations, legal doctrines, and supported by field data through interviews. The data were analyzed descriptively and interpretatively. The results show that legal protection for victims of Cyber sexual harassment in Indonesia is regulated in various legal instruments, namely the 1945 Constitution of the Republic of Indonesia, Law Number 12 of 2022 concerning the Crime of Sexual Violence, Law Number 1 of 2024 concerning the Second Amendment to the Information and Electronic Transactions Law, Law Number 31 of 2014 concerning Witness and Victim Protection, the Criminal Code, and the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW). Viewed from Aristotle’s theory of justice, these regulations generally reflect the principle of distributive justice through the provision of legal protection for victims and corrective justice through law enforcement mechanisms and victim recovery. However, there is still an imbalance between the punishment of perpetrators and the recovery of victims; therefore, stronger legal implementation is needed that is more oriented toward fulfilling victims’ rights and recovery in order to achieve substantive justice.
