Abstract
This study aims to comprehensively examine the legal qualification and criminal liability of perpetrators abusing deepfake technology and synthetic media as instruments for extortion and immoral crimes. The analysis is based on current positive Indonesian law (lex lata), encompassing the National Criminal Code, ITE Law, and Pornography Law, combined with the perspective of Islamic criminal law (fiqh jinayah), to formulate an ideal criminal policy framework for the future (lex ferenda). The background is driven by the massive democratization of artificial intelligence (AI), specifically Generative Adversarial Networks (GANs), which has shifted into an instrumentum delicti. This technology fabricates hyper-realistic synthetic realities, such as non-consensual pornography, that severely destroy the victim's dignity, privacy, and psychological well-being. The research method used is normative juridical, descriptive-analytical in nature. Legal materials are processed qualitatively using a deductive logic flow, alongside statutory and conceptual approaches. The results indicate that in positive law, current regulations still suffer from systemic legal weakness (fragilitas legis) and norm ambiguity (vage normen). This is due to a content-based enforcement paradigm that solely focuses on the distribution of the final product, allowing creators to frequently escape legal entrapment under the pretext of "personal collection". From the perspective of fiqh jinayah, deepfake manipulation is a modern manifestation of Qazf (false accusation), Buhtan (grave slander), and Tajasus (privacy violation), punishable by Ta'zir. Through the application of the Sadd al-Dhara'i' principle, unauthorized creation is absolutely forbidden from the pre-production stage to realize Hifz al-'Irdh (protection of honor). As a realization of lex ferenda, future law enforcement must shift to a conduct-based paradigm that explicitly criminalizes the acts of creation and storage. This concept also imposes active preventive obligations, such as watermarking, on Electronic System Providers (PSE), and integrates victim recovery through restorative justice balanced with judicial pardon (rechterlijk pardon) for legitimate innovation.
