Abstract
The rapid development of e-commerce in Indonesia has led to the emergence of various transaction methods, one of which is the pre-order system through social media, which often uses a down payment (DP) as the initial payment. However, this practice raises legal issues due to the ongoing uncertainty regarding the validity of the down payment and weak consumer protection in the event of default or fraud. The purpose of this study is to analyze the validity of down payments in pre-order transactions based on positive law in Indonesia and to explain the form of legal protection for consumers in transactions in the event of loss, fraud, or default. The research method used by the author is normative juridical research with a regulatory and conceptualization approach, using secondary data in the form of primary, secondary, and tertiary legal materials analyzed qualitatively. The results of the study indicate that down payments in pre-order transactions through social media are, in principle, valid as long as they meet the requirements for a valid agreement in the Civil Code and do not conflict with the provisions of the Consumer Protection Law and the Information and Electronic Transactions Law. In addition, consumer legal protection can be provided through preventive measures in the form of obligations for business actors to provide clear, honest and transparent information, as well as repressive measures in the form of resolving cases and imposing sanctions on business actors who commit default or fraud
