Abstract
The development of application-based transportation technology has given rise to new legal implications, including the misuse of online motorcycle taxi services as a means of narcotics distribution. This phenomenon creates complexity in law enforcement, particularly in determining the criminal liability of the drivers involved. This study aims to analyze law enforcement against online motorcycle taxi drivers as narcotics distributors based on Law Number 35 of 2009 and to examine judicial considerations through the perspective of legal realism theory. The method used is normative legal research with statutory and conceptual approaches. The results show that online motorcycle taxi drivers can still be held criminally liable as long as the element of fault is fulfilled, either as couriers or as part of a distribution network. However, in judicial practice, judges still tend to focus on the fulfillment of normative elements without comprehensively considering social and economic aspects as well as the level of the offender’s involvement. In conclusion, a legal realism approach is needed to ensure that law enforcement becomes more contextual, fair, and reflective of substantive justice. It is recommended that law enforcement officials and policymakers integrate an empirical approach into law enforcement practices and strengthen regulatory oversight of online transportation.
