Abstract
The advancement of information technology has led to the emergence of financial technology (fintech) innovations, one of which is the Buy Now Pay Later (BNPL) service that uses electronic agreements. This study aims to analyze the validity of clickwrap agreements as a form of digital consent in BNPL services in Indonesia, based on Article 1320 of the Civil Code, the Electronic Information and Transactions Law (UU ITE), and Government Regulation No. 71 of 2019. Additionally, this study identifies the challenges and legal risks faced by consumers and service providers in using this agreement model. The research method employed is a normative-empirical approach with a descriptive-analytical approach. The data sources include primary and secondary legal materials, as well as primary data obtained through a questionnaire distributed to BNPL service users to assess their understanding of the legal consequences of the "click agree" action. The findings show that clickwrap agreements have legal standing and are equivalent to conventional agreements because they meet the digital agreement requirements. However, there are significant challenges, including low consumer literacy regarding the lengthy terms and conditions, as well as the risks of personal data misuse and the imbalance of bargaining power between business actors and consumers. Therefore, strengthening transparency and compliance with personal data protection regulations is necessary to mitigate legal risks in the future.
