Abstract
The evolution of the digital ecosystem, particularly User-Generated Content (UGC) applications such as Roblox, presents new challenges in the protection of Intellectual Property Rights (IPR) for video game developers. The phenomenon of unauthorized video game adaptations within the Roblox ecosystem is increasingly prevalent, as evidenced by the adaptation of the video game Peak into Cliff and Growtopia into Blocktopia on the Roblox application. This research aims to analyze the forms of IPR legal protection for video game developers whose works are adapted on the Roblox application based on both national and international law, as well as the legal liability of the parties involved in such adaptation cases. This study employs a normative-juridical method with a literature review approach, examining primary, secondary, and tertiary legal materials. The results indicate that video game adaptations on Roblox legally qualify as copyright infringement because they incorporate substantial expressions of the original work without authorization, violating Article 40 of Law No. 28 of 2014. In practice, the most effective resolution mechanism is the DMCA Takedown under Section 512 of the United States Code, as exemplified by the removal of the “Lamborghini Miami” experience on September 30, 2022, following a notification from Automobili Lamborghini S.p.A. to Roblox, which resulted in the removal of all Lamborghini-related content across the platform. Protection is available through both national and international instruments. Legal liability is multi-layered: Roblox users, as direct infringers, can be held liable under civil or criminal law, while Roblox Corporation, as the service provider, can be held accountable based on the principle of vicarious liability. The primary obstacles to enforcement include user anonymity, the principle of copyright territoriality, and the vacuum of norms in the regulation of foreign digital applications.
