Abstract

This study aims to analyze the impact of the Electronic Information and Transactions Law (ITE Law) on freedom of expression in Indonesia from a positive legal perspective, as well as to formulate an ideal legal policy to regulate freedom of expression to support democracy. The background of this study is based on the tension between the regulation of digital space through the ITE Law and the guarantee of freedom of expression in the constitution, especially due to the existence of articles that are open to multiple interpretations. The research method used is normative-empirical legal research with a legislative and conceptual approach to the news. The legal materials consist of primary, secondary, and tertiary legal materials collected through literature studies, then analyzed qualitatively. The results of the study indicate that the ITE Law plays an important role in regulating activities in the digital space and preventing the abuse of freedom of expression. However, the existence of multi-interpretable norms creates legal uncertainty and a deterrent effect (chilling effect) for the public in expressing opinions. This has an impact on decreasing public participation and the quality of democracy. Therefore, legal policy reformulation is needed through clear norms, proportional restrictions, and accountable law enforcement guidelines. Furthermore, synchronization with human rights principles and the constitution is crucial to guarantee the protection of freedom of expression. The study's conclusion confirms that the ITE Law still requires improvement to align with democratic principles and human rights protection.
