Abstract
Illegal logging is a form of environmental crime that has serious consequences for forest ecosystem degradation, financial losses to the state, and the disruption of social balance within communities. Law enforcement regarding this crime has thus far been dominated by a retributive approach focused on punishment, and has therefore failed to provide for the restoration of damaged environments. This study aims to analyze the application of restorative justice principles in the enforcement of laws against illegal logging in Indonesia and to examine the legal considerations of the judge in Judgment No. 28/Pid.B/LH/2023/PN Wno. The research method used is normative legal research employing a statutory approach and an analytical approach. The legal materials used include primary and secondary legal sources analyzed through a descriptive qualitative approach. The results of the study indicate that, normatively, the principles of restorative justice have gained legitimacy within Indonesia’s criminal justice system through various regulations. However, in practice, the application of this principle in illegal logging cases remains limited. Judgment No. 28/Pid.B/LH/2023/PN Wno indicates that judges still tend to use a retributive approach, although there are considerations that implicitly reflect the values of restorative justice. This study concludes that the application of restorative justice in illegal logging crimes has not been optimal and requires strengthening in both regulatory and implementation aspects, particularly in integrating environmental restoration as part of law enforcement.
