Abstract

This research proposes to explore the conformity of Surakarta District Court Decision Number 207/Pdt.G/2024/PN Skt with the criteria of the Notary Law and to assess the kind of legal protection for notaries regarding the deeds they write up in civil cases. This study utilizes a normative legal research strategy with a legislative and case approach, backed by primary and secondary legal sources. The results of the study show that the court decision raises legal issues because the panel of judges declared that the notary had committed an unlawful act and declared the deed null and void without considering the principle of protection of the notary's position, the approval of the Notary Honorary Council, and the limits of the notary's liability, which only covers the formal validity of the deed. Therefore, this judgment is judged not to be totally in compliance with the Notary Profession Law and has the potential to generate legal uncertainty for the notary profession as a public authority.
