Abstract

Termination of Employment (PHK) is a crucial issue in industrial relations that has the potential to cause social conflict if not resolved properly. Law Number 2 of 2004 concerning the Settlement of Industrial Relations Disputes (UU PPHI) requires that every industrial relations dispute be resolved first through non-litigation mechanisms, especially mediation, before being brought to the Industrial Relations Court. This study aims to analyze the role of the Disnaker Surakarta City in resolving industrial relations disputes due to layoffs through the mediation stage and identify obstacles faced in its implementation. The method used is empirical juridical with a sociological approach, through direct interviews with mediators from the Disnaker Surakarta City. The results show that the Surakarta City Manpower Office has carried out its role as a mediator neutrally and independently by implementing effective strategies in the form of limiting the parties who speak, encouraging constructive deliberation, and ensuring equal bargaining positions for the parties. The obstacles faced include a lack of understanding by the parties, particularly workers, regarding the mechanisms and stages of mediation. The physical absence of one party due to geographical factors has prompted the Disnaker to develop online mediation, but it still faces technical obstacles and lacks a comprehensive legal basis under the Industrial Relations Dispute Resolution Law.
